MINUTES OF THE JOINT REGULAR CALLED MEETING OF THE TYE ECONOMIC DEVELOPMENT CORPORATION AND THE TYE INDUSTRIAL DEVELOPMENT CORPORATION, TYE, TEXAS

MONDAY, MARCH 13th, 2023

6:00 PM

The Tye Economic Development and the Tye Industrial Development Corporations met for a Regular Called meeting on Monday, March 13th, 2023, at 6:00 PM, at 649 Scott Street, Tye, Texas 79563 in Suite 111.

  1. Call to Order – George Deffenbaugh, President of the Board of the Tye Industrial/Economic Development Corporations called the meeting to order at 6:00 PM.

Members present – George Deffenbaugh, Kenny Dry, Barbara Kotrlik, Vada Childers, Ken Arnold, Janie Ritter

Members absent – None.

 

Others Present – Mayor Nancy Moore, City Attorney Eileen Hayman, Mary McCarty, Lena Minor, Marie McCarty, Celeste Votaw

 

  1. Invocation – Given by Vada Childers

 

  1. Public Comment – At this time, any person with business not scheduled on the agenda may speak to the Board of Directors. No formal action can be taken on these items at this meeting. Citizens speaking time may not exceed three (3) minutes without the consent of the Board of Directors. – No Comments.

 

  1. Executive Session: The Commission reserves the right to adjourn into executive session at any time during the meeting to discuss any of the matters listed, as authorized by Texas Government Code, Section 551.074 (Personnel Matters), Replacing 7th Board Member, Section 551.087 (Economic Development), Project Teamwork, Section 551.071 (Consultation With Attorney), Property Taxes

 

George Deffenbaugh announced that the boards were entering Executive Session at 6:03. It was announced that the board came back into Open Session at 7:08 PM. No votes or action were taken in Executive Session.

 

No action was taken on these items at this particular time.

 

Original Item #7 was then moved to Item # 5.

 

  1. Discuss and Consider: Property Taxes for 2021 & 2022 for ATX Auctions and Tye Family Care.

 

City Attorney, Eileen Hayman, explained that in 2021, the boards were given incorrect information from our previous City Attorney, and under the terms of the ATX Auctions and Tye Family Care lease agreements with Tedco/Tidco, the property taxes were the responsibility of Tedco/Tidco, and the boards were considering reimbursing ATX Auctions and Tye Family Care for the 2021 property taxes and their attorney fees to correct this issue. Lena Minor, Mary McCarty, Marie McCarty, & Celeste Votaw, spoke on this topic and informed the boards of their feelings towards this issue. The boards offered an apology to ATX Auctions and Tye Family Care and both companies accepted the apology.

 

Motion made by Barbara Kotrlik to reimburse ATX Auctions and Tye Family Care for the 2021 property taxes in the amount of $1,664.88 per company, to be split evenly between TEDCO (6810 Projects General) and TIDCO (6830 Projects General), and to reimburse Tye Family Care for their attorney fees in the amount of $250.00, to be split evenly between TEDCO (6810 Projects General) and TIDCO (6830 Projects General), and to reimburse ATX Auctions for their attorney fees once an official invoice has been presented, to be split evenly between TEDCO (6810 Projects General) and TIDCO (6830 Projects General), and to accept the Executive Director’s decision to void the invoices for the 2022 property taxes, and this motion would conclude this matter. Janie Ritter seconded the motion. Motion carried.

 

  1. Discuss and Consider: Approval of joint minutes for both TEDCO and TIDCO from February 13th, 2023.

Motion made by Vada Childers to approve the joint minutes for both TEDCO and TIDCO from February 13th, 2023. Ken Arnold seconded the motion. Motion carried.

 

 

  1. Discuss and Consider: Approval of financials for both TEDCO and TIDCO for February 2023.

 

Motion made by Janie Ritter to approve the financials for both TEDCO and TIDCO for February 2023. Ken Arnold seconded the motion. Motion carried.

 

  1. Adjournment: Motion made by Barbara Kotrlik to adjourn at 7:35 PM. Ken Arnold seconded the motion. Motion carried.
